Understanding the Chief Responsibilities of a Bail Bond Cosigner

Document for release of prisoner, Bail Bond

When you become a cosigner for relatives or close friends, you should fulfill a few responsibilities. We understand that a cosigner has to fulfill all the financial obligations associated with the bond. A defendant has the right to choose someone he trusts and has faith in, while the bail bond agency has the ultimate authority or power to decide whether the cosigner is approved to cosign the bond.

According to experts at Forbes, poor individuals may not have the money to pay for their bail. Hence, poor defendants when charged with petty crimes are compelled to face and accept ‘indefinite incarceration. However, rich individuals who have been accused of the same or even worse offenses are released because they are affluent and have the necessary money to buy and enjoy their freedom.

When somebody agrees and decides to cosign a bail bond, it becomes his responsibility to fulfill the bail obligations and pay the necessary fees charged by the bail bond agency. Defendants may require assistance from a cosigner, when they are unemployed, have a poor credit history, have a criminal record, or are considered a flight risk. Cosigners are there to act as the defendant’s support system and ensure that he steers clear of committing any other crime. Let us discuss the chief responsibilities of a cosigner.

Guaranteeing Payment of the Bail Amount

A cosigner’s chief responsibility is to arrange the required funds and pay the bail bond on behalf of the defendant. He has to guarantee payment of the bail. A cosigner takes upon himself the responsibility of providing the necessary funds to the bail bond agent to facilitate the seamless release of his friend or relative.

Providing the Collateral

One of the advantages of a bail bond is that you may not pay the entire bail amount in hard cash. You may pay around 10% of the bail amount in cash, while the rest of the amount due needs to be paid not in cash but by providing collateral for covering the due amount not paid through cash. It is one of the chief bond cosigner responsibilities to provide the collateral in either personal or real property. The bail bond agents will be taking charge of the collateral until the defendant’s case is finalized. In case the defendant’s bail is revoked, you will be losing your collateral.

Ensuring that the Defendant Attends Court on Time

It is a cosigner’s responsibility to ensure that the defendant turns up in court without fail as per scheduled appointments. The defendant has to attend every court date. If your relative or friend fails to be at a court hearing on a pre-scheduled date, the judge may consider revoking the bail.

Ensure that the Defendant Does Not Commit Any Other Crime

Keep your friend or relative away from any trouble. He should attend all court hearings on time and follow all relevant rules.

A cosigner must acquire sound knowledge of the bail bond restrictions that the defendant needs to follow when released from custody. Ensure that the defendant sticks to following curfew orders and stays at home whenever necessary. Avoid contacting co-defendants or victims. Do not try to influence them. Make it a point that the defendant obeys all associated travel restrictions.
